These Terms of Service govern your use of tryquietkind.com and any purchase you make from it. The site is operated by Quietkind ("we", "us"). By browsing the site or placing an order you agree to these terms. If you do not agree with them, please do not use the site.

Our Privacy Policy, Shipping Policy, Refund & Returns Policy and Cookie Policy form part of these terms.

1. Who can use this store

You must be at least 18, or the age of majority where you live, to place an order. By ordering you confirm that you are, and that any information you give us is accurate and complete.

2. Your account

You do not need an account to order, but if you create one you are responsible for keeping your password confidential and for what happens under your login. Tell us promptly at support@tryquietkind.com if you think someone else has access. We may suspend or close an account that is being used fraudulently or in breach of these terms.

3. Products and descriptions

We describe our products as accurately as we can. Photographs, renderings and videos are illustrative: colours vary between screens, and accessories shown alongside a product are not included unless the description lists them. Dimensions and weights are approximate and subject to normal manufacturing tolerance.

Products are offered subject to availability. We may change or discontinue a product at any time without notice.

4. Prices, promotions and errors

Prices are shown in US dollars (USD) and exclude sales tax, which is calculated at checkout where applicable. Prices can change at any time, but a change never affects an order we have already accepted.

Where we show a struck-through comparison price, it reflects a price at which the item was genuinely offered for sale by us, not an invented anchor. Promotional codes are subject to any conditions stated with them, cannot be combined unless we say so, have no cash value, and may be withdrawn at any time.

Very occasionally a product may be listed at an incorrect price because of a typographical or system error. We reserve the right to cancel any order placed at an incorrect price, even after it is confirmed. If that happens we will contact you, refund you in full immediately, and give you the chance to reorder at the correct price.

5. Orders

Your order is an offer to buy. Our confirmation email acknowledges that we received it; the contract is formed when we dispatch the goods. We may refuse or cancel any order — for example where a product is out of stock, where we suspect fraud, where an order looks like it is for resale, or where the price was wrong. If we cancel after taking payment, we refund in full.

We may limit quantities per person, per household or per order.

6. Payment

Payment is taken at checkout through our payment providers. By submitting payment details you confirm you are authorised to use that payment method. We do not store full card numbers — see the Privacy Policy.

7. Delivery and risk

Delivery is covered by our Shipping Policy. Delivery estimates are estimates, not guarantees. Title and risk of loss pass to you on delivery — but if a parcel is lost or damaged in transit we will replace or refund it as set out in that policy, so in practice you are not left carrying it.

8. Returns, trial and warranty

Returns, the 90-day home trial, refunds and the limited warranty are covered in full by our Refund & Returns Policy, which forms part of these terms.

9. Safe and correct use

Our products are intended for ordinary household use. Please read the instructions supplied with each product and follow them, including any warnings about electrical safety, charging, batteries and cleaning. Quietkind is not liable for injury or damage resulting from use that is contrary to the supplied instructions, from commercial use, or from unauthorised repair or modification.

10. Reviews and anything else you post

If you submit a review, photograph, video, comment or suggestion, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt and display it in connection with our business, including in marketing. You confirm that it is your own work, that it is truthful, and that it does not infringe anyone's rights.

We publish reviews from verified purchasers. We do not delete or hide reviews because they are negative, we do not offer incentives conditional on leaving a positive review, and we do not write or commission fake reviews. Where a reviewer received a product free or at a discount, that is disclosed. We may remove content that is unlawful, abusive, off-topic, or that contains someone else's personal information.

11. Email and text messages

If you opt in to marketing emails you can unsubscribe from any of them using the link at the bottom. If you opt in to text messages, message frequency varies, message and data rates may apply, you can reply STOP at any time to end them and HELP for help, and consent to marketing texts is never a condition of purchase. Transactional messages about an order you have placed are sent regardless of marketing preferences.

12. Acceptable use

You agree not to use this site to break the law, to infringe anyone's rights, to submit false information, to introduce malicious code, to scrape or harvest data by automated means, to attempt to gain unauthorised access to any part of the site, or to interfere with its operation or security.

13. Intellectual property

The Quietkind name, logo, product names, site design, text, photographs and other content are owned by us or licensed to us and are protected by intellectual property law. You may view and print pages for your own personal use. You may not copy, republish, sell or use our content or branding commercially without our written permission.

14. Third-party links

The site may link to third-party websites and services we do not control. We are not responsible for their content, products or privacy practices, and a link is not an endorsement. Your dealings with them are between you and them.

15. Disclaimer of warranties

The site is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free or secure, or that any defect will be corrected. To the fullest extent permitted by law we disclaim all implied warranties in relation to the site itself, including merchantability, fitness for a particular purpose and non-infringement.

This does not affect the limited warranty on our products, or any consumer rights you have by law that cannot be excluded.

16. Limitation of liability

To the fullest extent permitted by law, Quietkind and its officers, employees and suppliers will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site or any product. Our total liability for any claim relating to an order is limited to the amount you paid for that order.

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you. Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

17. Indemnity

You agree to indemnify Quietkind against claims, losses and reasonable legal costs arising from your breach of these terms, your misuse of the site, or your violation of any law or third-party right.

18. Governing law and disputes

We sell only within the United States, and these terms are governed by United States federal law and by the law of the state in which Quietkind is established, without regard to conflict-of-law rules. Any dispute that cannot be resolved between us may be brought before a court of competent jurisdiction in the United States. Nothing here removes any right you have under the consumer-protection law of your own state.

Before starting formal proceedings, please email support@tryquietkind.com and give us 30 days to resolve the matter. Most complaints are settled at this stage and it costs you nothing to try.

19. General

If any provision of these terms is found unenforceable, the rest continues in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the policies referenced above, are the entire agreement between us. You may not transfer your rights under them without our consent; we may transfer ours if the business is sold.

20. Changes to these terms

We may update these terms. The version published at the time you place an order is the one that applies to that order. Continuing to use the site after a change means you accept the updated terms.
